SMS messaging terms & compliance

1. Program description: This messaging program sends customer care messages (such as replies to your inquiry, appointment confirmations, reminders, rescheduling updates and support communications) and, where you have separately consented, promotional messages, to individuals who have explicitly opted in through the chat widget on our website at https://smartinsightsmedialocal.com. Opt-in is collected via the on-site chat widget with dedicated checkboxes for SMS consent.
2. Cancellation instructions: You can cancel the SMS service at any time. Simply reply STOP to the same number that sent you messages. We will confirm your unsubscribe status by SMS, after which you will no longer receive messages from us. To rejoin, opt in again as you did initially.
3. Support information: If you experience issues with the messaging program, reply HELP for assistance or contact us at info@smartinsightslocal.com or (472) 212-0988 during business hours.
4. Carrier liability: Carriers are not liable for delayed or undelivered messages.
5. Message & data rates: Message and data rates may apply to messages sent to you from us and to us from you. Message frequency varies based on your interactions with our business. For questions about your text or data plan, contact your wireless provider.
6. Supported carriers: Our SMS program works with all major US wireless carriers, including AT&T, T-Mobile, Verizon and most regional carriers.
7. Age restriction: You must be 18 years or older to participate in our SMS program.

We comply with all applicable laws and regulations regarding SMS communications, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

If we build automated messaging for a client, that client is the sender of record for their own customers and is responsible for obtaining proper consent. We configure every client program to include sender identification, honour STOP and HELP requests, and never send messages to contacts acquired without consent.

General terms

The specific scope, fees and term of any engagement are defined in a separate written agreement between us and the client.

No guarantee of results

Marketing outcomes depend on factors outside our control, including market demand, competition, pricing, seasonality, crew capacity and how quickly leads are handled. Anything described on this site is illustrative and is not a promise of specific revenue, rankings or lead volume.

Client responsibilities

• Provide accurate business, licensing and service-area information
• Maintain the staffing needed to answer and follow up on leads
• Grant the platform access required to run campaigns
• Obtain and honour proper consent for any communications sent to their own customers, and comply with applicable advertising, licensing and consumer protection laws

Intellectual property rights

Our limited licence to you

The Site and all materials available on it are the property of SMART INSIGHTS MEDIA LLC and/or our licensors and are protected by copyright, trademark and other intellectual property laws. The Site is provided solely for your personal, non-commercial use. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works from, exploit or distribute any material from the Site, except that you may download or print one copy of individual pages for personal, non-commercial use, keeping all proprietary notices intact.

Your licence to us

By submitting any material to us through the Site or other digital channels, you represent that you own it or have the necessary permissions, and you grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide licence to use, modify, transmit, distribute, create derivative works from and publicly display that material.

Deliverables created for a client are addressed in that client's agreement; our standard practice is that campaign assets and advertising accounts remain the client's property.

The information, products and services offered on or through the Site are provided "as is" without warranties of any kind, either express or implied.
